We have talked about the challenges to 18 USC 922(g)(1) more times than we can count. It is an issue that is not going away, but the Supreme Court seems to want nohting to do with it. Washington Gun Law President, William Kirk, discusses a brutal loss DOJ recently took when the Supreme Court rejected, and rather quickly, a challenge to a prior ruling out of the 5th Circuit which found that this law was unconstitutional as applied to a Defendant who had previously been convicted of marijuana cultivation. The ruling of the 3-judge panel was unique, but what the Supreme Court did to it was even more unique. So learn how DOJ just took one on the chin and arm yourself with education.
